He won’t retire, why else is he letting his lawyer go through with it? Lawyers aren’t cheap, especially good ones like this one apparently is. If he really retired he could have just accepted the suspension and keep his money in his pocket. He is fighting it so I’m pretty sure he will not retire.
Lawyers are hilarious. Borrow a concept from science, structure the phrasing as if “marijuana metabolites”, are a completely different component of “marijuana”, and see if they will bite. The pointhere with the rule, is there is supposed to be no level or trace of marijuana metabolites at all. Will be interesting to see the outcome. Maybe the guy who gave him the marijuana tampered with the levels of THC because he was racist. lol
I would say it goes by the letter of the rules, not the spirit of the rules. What the rules say means a lot more than what they “intend”.
Pretty wrong because metabolites could mean anything. It could mean that he was near someone who smoked and inhaled. I mean he has to breathe right? That’s just one of many arguments that his legal team could use to beat this. Which is why the AC didn’t specify that particular phrase in the rules. It creates too many issues and too many revisions. Nick’s lawyer just looked through the fine print. And there is no such thing as “common unspoken law” in any constitution or legal parchment. If it wasn’t written down then it’s pretty much null and void and Nick can get away with it.
Even if it was marijuana, does any other fighter really care? Does any fight fan really care?

Marijuana is mood altering. If it could be considering mood altering to the point where it could be considered advantageous (PED) to an athlete over his opponent, then it shouldn’t be allowed. No exceptions for Mr. Diaz. But where there is money involved, there is corruption and compromise. So, I expect this judgment may go in his favour. That’s fine if they want to adjust the rules for the future. But I wouldn’t go making it permissible for everyone – just those of medical necessity and issued licence as such.
Percocet, unlike Marijuana, is a fully legal prescription drug in all 50 states and yet you can’t use it within days of a fight. Same with cold medicines in most Olympic level testing competitions. Just because something is “legal” in one state (and yet not the state where he was competing and testing)doesn’t mean it’s legal to take it before a fight. This man has boasted MANY, MANY TIMES about his ability to beat a drug test, basically throwing it in the face of the commissions. Also this lawyer speak my be difficult for most to understand so let me break it down for you: I work in a medical lab and perform urine drug testing (which I’m sure is the method used by the NSAC). The way that marijuana is traced in your system is that it metabolizes after intake and those metabolites remain stored in your body fat for a period of time that varies based on the user. Unless you actually see the user ingesting the marijuana the only way that it is traced is through the metabolites that it leaves in your system after your body starts breaking the chemical down. THIS IS HOW DRUG TESTING HAS BEEN DONE, WITHOUT QUESTION, FOR DECADES! This argument is completely futile and will be torn to shreds if the NSAC brings it to appeal and has an expert in the field testify.
He should be gone. If you are going to be in a professional sport then put away the drugs. His defense is idiotic. I don’t care who smokes a little weed, but come on. If you are going to do it then at least be a man and face up to it.
