Joe Torrez May Face Charges After Defending Home Invasion


27-year-old professional MMA fighter Joseph Torrez has made international news when he defendes his home from four men who broke in early on New Year’s Day.  Of the four men who invaded the house, one died on the scene, another was hospitalized and two more were arrested.  It seems now that Torrez could be charged with homicide.

The news of Joseph Torrez’ ordeal has made headlines.  Torrez’ home was invaded on New Year’s Day, and the 27-year-old MMA fighter successfully fought off his attackers.  Of the four suspects, one was found dead on the scene, another was sent to the hospital and two more were arrested.  Now, a New Mexico attorney is preparing for the possibility that Torrez be charged with homicide.

The Las Cruces Sun-News covered the case:

A Las Cruces attorney Sunday started an online campaign in support of Joseph Torrez. The 27-year-old construction worker and mixed martial arts fighter reportedly fought four gang members on New Year’s Day after they forced their way into his home on King James Avenue near the community of Doña Ana, according to court documents and Torrez’s attorney, C.J. McElhinney.

In his initial post on the “Support Joe Torrez” Facebook page, McElhinney wrote: “Unfortunately, I think we are at the beginning of a very long fight. Please know that I have advised Joe to make no statements of any kind until this situation is resolved. He is reading all of your posts and truly appreciates your support.”

McElhinney said he advised Torrez to stop cooperating with the Doña Ana County Sheriff’s Office late last week during an interview with investigators. Initially, McElhinney said, investigators had called it a self-defense case.

      I will start by saying that I am a centrist leaning to the liberal side of the political spectrum. That being said, liberal media makes the Martin-Zimmerman case look like something it is not. Do some fact-checking. The court did not invite an entire racist jury to evaluate the case. That means that evidence of legal wrong-doing was not clear or present.

    Prosecutor wants to be a judge and possibly mayor one day he needs his name in the paper n get some notoriety. This is the only way being that its in Las Cruces.

    So it’s ok to shoot an unarmed boy out on the streets, but you can’t defend your wife and child in your own home against 4 dudes with a knife?

    It would have been self-defence.

    A lot of judgements on here from a lot of ignorant people. No one knows what happened. No one on this board was there.

    Let’s say you’re walking down the street and someone pulls a knife out and tries to rob you. You draw your firearm and shoot them. The knife goes flying and the perpetrator falls to the grown. He’s laying there crying for his mommy. According to every law in every state there are varying situations where shooting someone in self-defense is justifiable. In this scenario, it is. Where the problem with legality lies is when the shooter then walks over the the now disabled perpetrator after the threat to him no longer exists, plants the barrel of his pistol against their forehead and blows his brains out. That’s not legal. We are allowed to defend ourselves but we are not allowed to be judge, jury and executioner. Especially where the crime committed would never lead to an actual death penalty.

    With they said, I have no idea what happened here either. But hypothetically, if he killed someone who was at the time obviously no longer a threat, he could get jammed up.

        An initial report I read said the body was found outside the house. That was only thing that made the possible charges sound possible. Granted, a man stabbed in the house can still flee.

    If a person (or people) force entry into someone’s home with the intentions of causing harm, the home-owner should be able to defend — up to and including an end result of death. Regardless of race, color, armed/unarmed, etc.. You don’t want to get “attacked”? Keep your sorry ass out of someone else’s home! Good luck, Torrez.

    The fact is that he was outnumbered 4 to 1. If he paused to have slightly injured the pepetrator, the perp could still retaliate. They had contacted him ealier and said they were going to kill his family. Justified rage.

    He had EVERY right to engage in a robust defense of hearth and home. Had he simply shot these people, we’d not hear this stupid noise about ‘legal charges’.

    Is it too goddamned much to expect people to NOT BREAK INTO OTHER PEOPLE’S HOMES?

    Torrez is the victim, here, as well as a hero. America’s priorities are all screwed up.
