Diaz NSAC Hearing Over | Suspended For 12 Months Fined 30%


Today the Nevada State Athletic Commission heard the case of Nick Diaz.

In February Nick fought and lost against Carlos Condit for the UFC’s interim welterweight title. In the post-fight drug screening Diaz was found to have marijuana metabolites in his system and as a result has been put under fire as a rule violator.

After a lengthy stint of legal back and forth the two sides met today in Nevada to determine the fate of Mr. Diaz.

A brilliant defense was presented to the commission. One that brought expert testimony that refuted the interpretation of the rules and had it been a court of law, I have no doubt that based on the testimony Diaz would have been found innocent.

The real issue is whether or not Nick was using a banned substance in competition. The state of Nevada could not prove that Nick was using during his fight, but the defense could not prove against it either.

It was a lengthy hearing, the two sides argued the rulebook and facts of the case back and forth. However the NSAC is their own judge and jury and as a result are not liable to answer to anyone other than their own interpretation of the rules.

In the end Nick Diaz will not be able to compete in the State of Nevada until February 2013. He received a 12-month suspension and was fined 30% of his fight purse and bonus money.

        If it wasn’t for the nsac there wouldn’t even be fighting. No other state would allow fighting a few years ago. Fuck all wiening pro athletes, if they can’t follow simple rules then be a bum like the rest of us!! They’re treated too good so they could at least act like they are worth it.

          I get that he wants to get high, who doesn’t, but when I break the rules and get caught I pay the price. He knows the rules. I used to be a huge Diaz fan, but all he’s proved is that he belongs on the streets of Stockton, fighting cuz he’s a thug. He’s no professional athlete!!!

        It’s typical Diaz fans who can’t write in complete sentences that are angered over this. He can still fight in other states so it’s not the end of the world. Didn’t he say he was retiring any ways? Or was that just a little tantrum after he lost to Condit.

          The suspension will carry over and be honored in all other comissions in North America. The UFC won’t likey schedule him in a bout either until his suspension is over, simply to stay on good terms with the NSAC and to show that they have no tolerance on anyone breaking rules or show favoritism towards any particular fighter.

    Bullshit ruling, The state of Nevada could not prove that Nick was using during his fight, there fore they can not find his guilty. Just like in a a murder trial if you cant prove a person commit the crime regardless of the presentation of defense they charge would have to be dismissed.

      he doesn’t have to be caught using during the fight, it’s a part of the licensing process. Just like Overeem wasn’t caught using during a fight. There’s a list of “do not use” items. One of them is Apsrin….it’s fucking simple. You want your license stay off the banned items.

    • Yea, only its not a court of law and they don’t need a level of proof that fits your definition. They can suspend if they see fit for however long. I mean, if its on the ban list then expect to be punished when they find it in your system.

      you must be confused. TRT is the misplacement of ORGANIC hormones in a legal treatment using ORGANIC hormones. To put into simple terms for simple minded people like your self its replacing androgen hormones that your body naturally produces. Steroids are drugs that mimic the effects of testosterone and dihydrotestosterone in the body, mainly synthesized. Shooting up roid and getting TRT are two different things because when you test some one for both, for TRT you only can detect raised levels of testosterone with out substances, with steroids you can trace both in a test…… again for simple minded people like yourself i will use an analogy TRT is like getting a heart transplant from a human donor and steroids is like getting a transplant from a gorilla.

        If you can’t naturally compete, you shouldn’t be competing. TRT should be just as illegal as steroids and weed. If you’re using TRT to get back to normal levels, then it gives you just about the same advantage as weed does.

    12 months is kinda a long time for marijuana compared to some fighters that appealed and got their 12 months down to as low as 6 months. NSAC system reminds me of Roger Goodell and his system he has…no rhyme or reason.

    I wish we would just legalize marijuana; I’m not a fan of using it, but the legal penalties are way overblown; seems it should be controlled in a manner similar to alcohol. I like watching Diaz fight so this is disappointing.

    I’m not much of a Diaz fan, but have to admit this is kind of silly. Marijuana is not a performance enhancing drug. If anything it’s the opposite. Still he knew that he could be tested, and should have cleaned up prior to the fight. I think he’s just scared of fighting St. Pierre! (I’m kidding, but you know Diaz would say that if the situation were reversed)

      It actually could be performance enhancing if it calms a fighter down before a competition. That being said the suspension seems a bit much but pretty much every sports organization isn’t cool with their athletes doing drugs.

    I understand that a banned substance is exactly that and therefore no matter what it is you have no-one else but yourself to blame.
    However surely a bit of marijuana is in no way on the level of roids/trt so there should be a ‘class of ban’ relevant to the the substance!?
    About the UFC and other organisations had a say in the ‘banning rules’ not in individual cases but in overall guidelines! 12 month for weed is bollocks but a guess thats just my opinion!

    It’s like the commission was upset that he tried to defend himself and brought in a lawyer. Like they were upset he had a legitimate chance of proving his case. 12 months is a disgrace. Didn’t Overeem get 9 months? 12 months is basically not allowing him to make a living. I’m not a huge Nick Diaz fan but 12 months is honestly too harsh.
